Appellate Advocacy

South Square has a strong market reputation for its members’ appellate practices, with members regularly arguing cases before the Court of Appeal, the Supreme Court and the appellate Courts of various other jurisdictions (including the Privy Council). Members’ appellate practices cover a wide variety of practice areas including insolvency/ restructuring, company law, fraud related disputes, commercial litigation, financial services, insurance and a number of others.

Many of our barristers are sought out specifically for their appellate expertise, with a view to maintaining clients’ victories on appeal or reversing losses at first instance. Members provide clients with a pragmatic, innovative and exemplary service and are often the first port of call for complex matters when an appeal is being considered or is already underway.

Appellate work differs from advocacy at first instance. It requires not only a thorough understanding of the appeals process but also the ability to apply a deep understanding of the law in innovative and practical ways. Anyone seeking to appeal a judgment should consider first if their barrister/chambers have a sufficiently strong track record in acting on appeal matters.

The depth and breadth of South Square’s appellate offering is illustrated by the experience of many members in recent cases before the Court of Appeal, including Robin Dicker QC (ENKA INSAAT VE SANAYI A.S. -V- OOO INSURANCE COMPANY “CHUBB” and PROJECT BEAR), Roseanna Darcy (PROJECT BEAR), Barry Issacs QC (PRUDENTIAL ASSURANCE COMPANY LIMITED), Felicity Toube QC (PROJECT PEAK and LIBYAN INVESTMENT AUTHORITY), Stephen Robins (PROJECT PEAK, LONDON MINING PLC (IN ADMINISTRATION), RICHARD SLADE V DEEPAK ABBHI,  DUCHESS VI CLO B.V. CLIENT – DEUTSCHE TRUSTEE COMPANY LTD and LONDON OIL AND GAS LIMITED (IN ADMINISTRATION)), Mark Arnold QC (BOXCLEVER GROUP), Jeremy Goldring QC (PROJECT HOLBORN), Tom Smith QC (PRIMEO vs HSBC, LEHMAN AUSTRALIA and PROJECT CELINE), Richard Fisher QC (PROJECT CELINE and RESOLUTION REAL ESTATE LTD), Daniel Bayfield QC  (INTERNATIONAL BANK OF AZERBAIJAN,  LEHMAN AUSTRALIA and LONDON MINING PLC (IN ADMINISTRATION)), Ryan Perkins ((INTERNATIONAL BANK OF AZERBAIJAN and LEHMAN AUSTRALIA), Andrew Shaw (LONDON OIL AND GAS LIMITED (IN ADMINISTRATION), Adam Al-Attar (JSC COMMERCIAL BANK PRIVATBANK and BANCO SAN JUAN V PDVSA – VENEZUELAN NATIONAL OIL COMPANY), Jamil Mustafa (BANCO SAN JUAN V PDVSA – VENEZUELAN NATIONAL OIL COMPANY), Charlotte Cooke (CANNON CORPORATE LIMITED) and Matthew Abraham (PROJECT FIRESTONE).
