The Moss-Fletcher lecture series is a tribute to the late Gabriel Moss QC and Ian Fletcher QC, sponsored by the International Insolvency Institute and South Square.
The inaugural Moss-Fletcher lectures were delivered by Sir Roy Goode KC in 2022.
Professor Westbrook’s lecture is described below:
The Law of Financial Distress: The Resolution Revolution
A Lecture in Honor of Gabriel Moss and Ian Fletcher
The fundamental nature of the law applied to a business in financial distress is changing in countries around the world. The goal of distressed legal proceedings has changed from liquidation to continuation of the business. We need a new word for the new concepts and processes that the change requires: “Resolution.” This lecture discusses how we might begin to fashion Resolution, starting with the lessons of forty years of Chapter 11 in the US, which inspired many of these changes around the world. One reform suggested is a new definition of COMI.
On Tuesday, 14 March at Noon, Professor Jay Westbrook will present the Moss-Fletcher Lecture on Insolvency. The lecture will be hosted by ITAM in Mexico City and will be available both in person and on zoom.
The second lecture in this year’s series will be presented by Professor Westbrook on 7 June, in Middle Temple in London. That event has been scheduled so that people who wish to attend both the lecture in London and the International Insolvency Institute Annual Meeting in person will be able to do so.
