Tom Smith KC and Matthew Abraham, instructed by Macfarlanes, successful represented Superdry in its restructuring of the Group’s financial and leasehold liabilities.
The decision is to be welcomed in the context of leasehold restructurings post the Court of Appeal decision in Adler. The Court took a pragmatic approach to the need to show good reasons when determining whether it is fair that certain liabilities are excluded from a plan and whether it is appropriate for equity to be retained where “in the money” creditors are being compromised.
