Butcher J has handed down judgment in the Commercial Court appointing Receivers over the non-Vietnamese assets of VietJet Aviation, one of the leading airlines in Vietnam. The Receivers were appointed in aid of execution of a series of judgments of the Commercial Court, under which VietJet owes FWA a sum in excess of US$250 million. The judgment sets out a clear analysis of the principles applicable to the circumstances in which the Court will appoint Receivers in aid of execution of unsatisfied judgments, including over foreign assets.
