Judgment Hand Down: FW Aviation v VietJet Aviation Joint Stock Company [2026] EWHC 2454 (Comm)

Butcher J has handed down judgment in the Commercial Court determining that in principle (subject to the terms of the order and evidence as to likely costs) it was appropriate to appoint Receivers over non-Vietnamese assets of VietJet Aviation, one of the leading airlines in Vietnam. The appointment of the Receivers was sought in aid of execution of a series of judgments of the Commercial Court, under which VietJet owes FWA a sum in excess of US$250 million. The judgment sets out a clear analysis of the principles applicable to the circumstances in which the Court will appoint Receivers in aid of execution of unsatisfied judgments, including over foreign assets.
