A number of our barristers are listed in the directories as leading practitioners in the insurance field. Work ranges from disputes about construction and coverage under policies, to the proper interpretation of domestic and European insurance legislation. Members have acted in recent landmark cases about the scope of insurance regulation, including the Policy Trigger and Digital Satellite cases at levels up to the Supreme Court. Members have particular recent experience of compulsory professional indemnity insurance.
Members advise and act in arbitration and court litigation for clients involved in the practice and regulation of insurance and reinsurance at all levels, both in the UK and overseas. They are familiar with commercial and regulatory issues affecting all forms of business organisation in the industry, from international groups to independent financial advisors. They have acted for insurance regulators in the UK and in other jurisdictions (including cases concerning unauthorised insurance business), for the Financial Services Compensation Scheme, the Council of Lloyd’s of London and Equitas.
Members also have extensive experience of the run-off and restructuring of insurance and reinsurance companies, including solvent schemes of arrangement under the Companies Acts and insurance business transfer schemes under Part 7 of FSMA. This includes landmark cases such as the WFUM pools and Equitable Life schemes of arrangement, and the Equitas Part 7 transfer scheme.
